Tennessee Theft/Fraud Laws

Theft takes many forms and can be classified as a misdemeanor or felony depending on the value of the property stolen. Additionally, theft can be classified as a violent crime if violence, the threat of violence, or a weapon was used during the theft. Other forms of theft include white collar crimes such as embezzlement and fraud; burglary, which involves breaking and entering to commit theft; and robbery, in which theft is committed through force.

Classifying Theft Offenses in Tennessee

Theft crime classifications include:

  • Class A Misdemeanor – when the stolen property is valued $500 or less
  • Class E Felony – when the stolen property is valued between $500 and $1000
  • Class D Felony – when the stolen property is valued between $1,000 and $10,000
  • Class C Felony – when the stolen property is valued between $10,00 and $60,000
  • Class B felony – When the stolen property is valued more than $60,000

What are the Penalties for Theft Crimes in Tennessee?

The most common kind of felony theft is robbery, mugging (robbery in a public place), & carjacking, which is the taking of valuables through force or violent means. Due to its violent nature, robbery sentences are typically 3 - 15 years in jail.

Through the years we have further classified theft crimes into many different types of offenses, all of which have their own laws and penalties. The severity of charges and penalties for a theft crime will vary depending on the amount of property involved and whether force was used.
